I hired a sales rep to represent my company in Canada, specifically Vancouver - I paid the gentleman $2,000 retainer in addition to sending him sales materials (brochures, etc.) that cost about $200 to print<br />--<br />He has not provided any information or sales leads<br />We had signed a sales contract which stated he would provide a list of sales leads and people he has contacted every 2 weeks - This has not happened - He has produced NO leads<br /><br />I am under the impression that he took the $2k and and has done absolutely nothing - We have had emails going back and forth regarding what he has been up to - He has mentioned that he has contacted people, etc., but it has led to nothing - He has never provided any list or report of sales leads...<br /><br />What are my options? I have a high priced attorney out of Silicon valley, but I would end up paying him more than the $2k I lost to the sales rep - I am a small startup and the $2k lost is not a huge deal, but I could have used the money on marketing<br /><br />Thanks<br />

If you entered into the contract in California, you can try to sue him in small claims court here. But you will have some problems with serving him the complaint if he is in Canada and getting the court to take jurisdiction over him.
My advice is to learn from this experience. The amount of money is not worth the headache of trying to get it back. |
